Abstract

The debate around the themes of the “refuge” and the “asylum” developed in the legal and philosophical reflection immediately after the Second World War, with the fundamental reflections of Hannah Arendt, but it has only received more visibility in recent years with the “refugee crisis”. The Francescomaria Tedesco’s book is a punctually documented contribution on the subject which, starting from the national and supranational normative data, develops a very dense theoretical reflection on one of the central themes of contemporary law. The “political” pressure exerted by public opinion on institutions (judicial, legislative, administrative ones) risks confusing the essential terms of the migration problem, favoring its exploitation and a narrative in “emergency” terms. On this ground processes of “otherization” take root, understood as performative discourses that put pressure on legal principles and institutions - such as asylum - that have historical and philosophical origins dating back over time and which, also for this reason, constitute bulwarks of European legal civilization. © 2019, Diritto e questioni pubbliche, Palermo.
