The quality of psychiatric court reports on asylum seekers [Zur qualität von gerichtsgutachten in aufenthaltsrechtlichen verfahren] (Article)

Abstract

A sample of 115 psychiatric and psychological expert opinions submitted to German courts in cases of asylum seekers was evaluated using 105 items to rate the quality of the individual expert opinion as well as the quality of the sample at large. The results of the study demonstrate that there was a small number of highly qualified expert opinions, whereas the majority of these did not meet the requirements for such opinions as laid down in the various Standards of Care for Writing Expert Opinions in Cases of Asylum Seekers. Depending on the combination of items, many opinions should have been rejected as invalid by the courts and the courts should not have reimbursed the experts for their insufficient work.
