Material and methods: Consideration of the legal and investigative practice from the point of view of the Federal Office of Migration and Refugees. Results: Torture by state or non-state actors can constitute an imminent persecution or a serious damage under the legal aspects of asylum and can lead to a protection. Torture that relates to medical ailments can also justify a ban of deportation. The enlightment is usually carried out by so-called special officers at the Federal Office of Migration and Refugees.
