Abstract

Taking as a reference the Council of Europe Convention on preventing and combating violence against women and domestic violence, this article discusses the trend towards the criminalisation of forced marriages in the European scenario and its pitfalls. It suggests to consider the manifest and latent functions of this practice and of legal responses to them in Western multicultural societies. The general cautions that guide the analysis is to explore other pathways from criminal law protection against forced marriages.
