The typology and specifics of criminological personal characteristics of a criminal guilty of kidnapping (Article)

Abstract

The paper is devoted to the criminological analysis of constituent elements of crimes that involve kidnapping. These elements are extremely variable in their objective and subjective characteristics. It is for this reason exactly that it is very difficult to present a generalized description of persons who commit the crimes under analysis. The main goal of working out different typological profiles of criminal personalities is to improve the law enforcement bodies’ understanding of this category of people, techniques and methods of exposing such crimes, to determine criminal liability measures for committing them as well as the future educational influence on criminals’ personalities. The typology of offenders can be developed with the aid of different approaches, grounds, criteria (legal, social, psychological, etc.), typology patterns (e.g., socio-demographic: gender, age, education, etc.). This study presents an attempt to divide offenders into two criminal types — endogenic and exogenic criminals — and their description. The typology of offenders who commit crimes involving kidnapping includes both people with a pronounced anti-social attitude and those without it. The first group of offenders includes the following persons: – those committing kidnapping for ransom or further trafficking or exploitation of victims; – those committing murders disguised as a person’s disappearance; – those committing terrorist crimes or other offences threatening people’s lives and resulting in their disappearance. The second group of offenders is comprised of those who committed crimes resulting in accidental consequences to other people. The study of a criminal personality cannot be complete without the understanding of the problem of personality in general and its life activity in particular. © 2015, Baikal National University of Economics and Law.
