This article evaluates the suitability of the discipline (legal framework) regarding the need to promote the human development of migrants' children and their social integration. This valuation is made taking into account that migrants' children are not a homogenous category from the legal point of view. Some of them are citizens, some enjoy the status of European, while others instead are non-European and at times irregular residents, and at times some are even asylum-seekers. For all of these categories, the article assesses the appropriateness of the discipline and identifies the main problems in detail; and proposes some possible courses of action to make the discipline more appropriate.
