Abstract

James Hathaway's recent work, in which he argues for a reconceptualization of refugee law and protection, has provoked extensive discussion. His paper entitled 'Reconceiving Refugee Law as Human Rights Protection" appeared in the Journal of Refugee Studies 4: 2, 1991, pp. 113-131. We publish here a critique by Daniel Warner of Hathaway's propositions, set out in that and other publications, followed by a reply from James Hathaway. © 1992 Oxford University Press.
